"Digital Copy" for Smartphones/Tablets (game licenses bundled with 3DS retail games)

I thought of a way Nintendo could offer games for smartphone/tablet platforms, without losing out on the profits they enjoy now. My idea is to bundle a sort-of "Digital Copy" system with certain Nintendo 3DS games. "Digital Copy" (or whatever it would be called) would consist of download files for up to three smartphones or tablets. With "Digital Copy," gamers would have the ability to take their Nintendo games anywhere they go, even if they do not have their 3DS with them. Of course, there would be restrictions put in place to avoid piracy, as well as selling individual "Digital Copy" licenses.

I figure that since charging $20-40 for an individual license would not be received well in the smartphone gaming community, offering multiple-device licenses as a bonus in retail games might just do the trick. How does this sound?

That wouldn't work. And Nintendo is not going to do that. Waste of time (and money).

Sims 3 did something similar, offering a console version, a computer version, and an iOS version for slightly more than the console version (was what got me to pick it up). Don't know how well that worked out for them, but it definitely gives people a nice incentive to pick a game up.

I originally thought of this idea for a potential Mario Kart 7 "Special Edition" bundle (as one of the bonuses), which is kinda similar to what you said.
