Bartow, FL (AHN) - Prosecutors have decided to file suit against 8 teenagers and have them tried as adults in the videotaped beating and meant for uploading on social network web sites of a 16-year old, and if found guilty may find themselves facing a maximum penalty of life imprisonment.
The teenagers, ranging from ages 14 to 18 years old, face charges of kidnapping, misdemeanor battery, and three of them facing additional charges of witness tampering. Several lawyers say that while the decision to charge the teenagers as adults was expected, it was also considered harsh and that not all of them should be charged as adults because of the varying levels of involvement they had in the beating.
The parents of the teenagers see this to be an excessive move by prosecutors, saying that they may have made a mistake but they should be tried as teenagers given the teenagers' mentalities that they still carry, and that the prosecuting team, led by Polk County Sheriff Gray Judd, is simply blowing the whole case out of proportion. Judge J. Michael McCarthy has issued a gag order over the lawyers and other individuals from speaking to the public about the case.
The beating of Victoria Lindsay, 16, took place on March 30, and was videotaped by the teenagers to be posted on MySpace and YouTube. They were aiming to retaliate using the video at the cheerleader to get back at several negative postings she placed on her page. Allegations refer that after beating her up the three 17-year old teenagers facing additional charges of witness tampering, Brittni Hardcastle, Brittany Mayes and Mercades Nichols, threatened to gang up on her again if she informed authorities of the incident, and dropped her off at an intersection. The beating took place in Nichols' grandmother's house while she was away at work, and the two boys, Stephen Schumaker, 18, and Zachary Ashley, 17 stayed outside the house to be lookouts. April Cooper, 14, Kayla Hassell, 15, and Cara Murphy, 16, were also part of the beating.
Lindsay is remaining in the hospital. Because her head was slammed to the wall more than one, she is suffering permanent hearing loss and blurred vision on her left ear and eye. Lindsay's family and Judd have called for the legislation of making social-network sites implement stricter rules on the posting of like videos and information.
