Sorry for the late creation of this thread.

Most people probably know this already, but two days ago the Supreme Court ruled 5-4 that the 2nd Amendment gives individuals the right to bear arms and thus overturning the DC handgun ban. The decision will probably also affect gun control laws as well.

Discuss.

Right to Bear Arms does not equal right to handguns. I never see why people can't get that. It was written for fucking Muskets.

They OVERTURNED it!? In the city that, on and off, has been the MURDER CAPITAL OF THE US!? I'm starting to lose faith in humans as a species.

I guess they really want to make it easy for President Obama to be assassinated.

The Washington Post had a few people in the editorial section accusing the conservative justices of being hypocrites by practicing judicial activism for the court ruling even though they advocate judicial restraint. I personally see it as the justices just trying to impose their own ideological goals for that case.

The undertones of "judicial activism" are a fairy tale. "Judicial activism" simply refers to a practice that has a long history going back to 1803 - when the Supreme Court staged one of the greatest powergrabs in history by allotting itself the power to strike down laws as unconstitutional. Truth is, very few judges have shied away from sweeping decisions that detail strong precedent, and Scalia is easily one of the most "activist" judges around.

In practice, this decision won't change much. The court can't enforce its rulings, so good luck trying to overturn a city handgun ban, practically.

How disappointing they made that decision, it's not the first time they have overruled the people. The same happened with gay marriages, however that was a positive decision to overrule them and this is a negative one. But then again the Supreme Court is often ignored anyways as it was over Guantanamo, so here's hoping xD

I guess they really want to make it easy for President Obama to be assassinated.
There have been multiple predictions made and even bets placed that Barack Obama will be shot in a time frame of around three months after assuming office.

Judicial Activism : (N). A supreme court decision the person talking disagree with.

I can't say I'm surprised. Too much of America has been interpreting the 2nd to say "I HAVE THE RIGHT TO AN ANTI-TANK ROCKET LAUNCHER UNDER MY BED!" for too long.

The problem with the constitution is, it was written for the 18th century. The second amendment, back then, would have allowed the people to rise up in arms agains an abusive government - everyone would have had the same guns.

It's woefully unadapted to the 21st. Today, given the weapon armies have, you either have a right to keep and bear arms that serves none of its original purpose (because it's limited to the sort of weapons, ie guns, the founding fathers might have thought about). Or, alternatively, you go with the literal reading, which would and should allow everything up to and including nuclear warheads to be built and owned by private militia - including such militia as are opposed to the central government, so long as they're well-regulated. And in fact, taking away the guns from the people (keep and bear arms) at any time while within US territory would be unconstitutional. Like, you know, "Oh, of course you can take your handgun on the plane, mr. bearded guy of somewhat dark skin tone!"

You know WHO would have a field day recruiting US-born muslims to organize them into a regulated militia, right?

If Bush hasn't been shot with all the shit he's pulled in the past 8 years, I think that Obama is safe.

I actually told my friend that I thought Obama (she's a big fan of him) would get assasinated if voted in ._.

What's sad is the main reason everything think he's going to be assassinated is solely because of race.

Are you saying that Washington, D.C. is going to ignore the Supreme Court?

I'm saying that D.C. can structure its laws in such a way that owning a handgun is nearly impossible. It's just a matter of making handgun possession such an inconvenience on the margin that no logical law-abiding citizen will do it.
